1. Acceptance of Terms

By accessing and using the HighThree website (the "Site"), you accept and agree to be bound by these Terms of Service. If you do not agree, do not use the Site.

2. Description of Service

HighThree provides free, client-side retirement estimation tools for employees covered by the Federal Employees Retirement System (FERS). The tools calculate projected pension amounts, TSP growth trajectories, break-even salary comparisons, and related retirement analytics based on user-supplied inputs and publicly available formulas from OPM, TSP.gov, and the IRS.

All calculations are performed in your web browser. No data is transmitted to any server.

3. Not Financial Advice

HighThree provides estimation tools for informational purposes only. The outputs of these tools are estimates, not guarantees, predictions, or professional financial advice. The tools do not account for every possible factor that may affect your actual retirement benefits, including but not limited to:

• FERS Annuity Supplement eligibility and amounts
• Sick leave credit toward retirement
• Law Enforcement Officer, Firefighter, or other special category provisions
• Future legislative changes to FERS, TSP, or Social Security
• Individual tax situations not captured by the simplified tax model
• State-specific retirement tax treatment beyond the single-rate approximation used

You should always consult a qualified financial advisor and your agency HR office before making career or retirement decisions based on these estimates.

4. No Warranty

The Site and its tools are provided "as is" and "as available" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Alexander Hewitt does not warrant that:

• The estimates will be accurate, complete, or current
• The Site will be uninterrupted or error-free
• Defects or errors will be corrected
• The Site or its servers are free of harmful components

5. Limitation of Liability

To the fullest extent permitted by applicable law, Alexander Hewitt shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Site
• Any errors or omissions in the estimates produced by the tools
• Any career, financial, or retirement decision made in reliance on the tool's output
• Any unauthorized access to or alteration of your locally stored data

6. User Responsibilities

By using HighThree, you acknowledge that:

• You are solely responsible for the accuracy of the inputs you provide
• You are solely responsible for verifying outputs against official sources (OPM, TSP, SSA, IRS)
• You will not rely solely on these estimates for financial or career decisions
• You are responsible for the security of your device and any exported scenario files

7. Intellectual Property

The content, design, code, and visual elements of the HighThree website are owned by Alexander Hewitt. The FERS formulas, TSP rules, IRS tax brackets, and other government sourced data referenced by the tools are public information and not subject to copyright by HighThree.

You may use the tool and its outputs for your personal, non-commercial purposes. You may export and share your scenario results. You may not reproduce, redistribute, or create derivative works from the Site's source code or design without written permission.

8. Modifications

These terms may be updated from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised terms. The effective date at the top of this page will always reflect the most recent revision.

9. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States and the state in which Alexander Hewitt resides, without regard to conflict of law principles.
